What is it? Well for audio it is called "Mechanical" and for software it is called "Distribution". These are licenses you must pay to record (audio) or distribute (software) other peoples works, their "Intellectual Property Rights". Mechanical Royalties are the fees that you must pay to the original writer and publisher of a song in order to be granted the legal right to record and duplicate your rendition of their song. Just like you would want to be paid if Garth Brooks recorded one of your songs, Garth Brooks wants to get paid if you record one of his!
Many studios look the other way on this issue and tell folks that these fees are
not payable "if you are only running a few hundred copies".... nothing could be further
from the truth and you are opening yourself up to the potential for litigation. Software
distribution generally only applies to CD-
Effective January 1st, 2005, we require all projects duplicated through us to be accompanied by declaration forms stating among other things, that you have acquired the proper licenses for the materials you are asking us to replicate. You may also be asked to provide copies of these licenses before any work begins. Please DOWNLOAD our form.
